Woman, nine children left homeless as court allows husband to sell marital home

Florence Nakiberu and her nine children, all residents of Kikungwe B village in Kimanya Kabonera division in Maska city are now  homeless after a court ruling allowed her husband also a father to her nine children, Frank Matumbwe to sell their marital home.

According to Nakiberu, the couple has been married since 1997 but  trouble started when Matumbwe began showing intentions of selling  their shared property, prompting Nakiberu to seek intervention from authorities.

“He first sold the Kibanja we owned together and I kept quiet but when he decided to sell the plot where we built our marital house,  I decided to take the matter to the LC1 chairman who called him but he refused to go there. I took the matter to police that called and again he refused and the matter was forwarded to the deputy RCC Kateregga Musaazi," Nakiberu said.

"However, on April, 18, the LC1 chairperson John Kintu served me with documents which are asking  me to present myself to courts of law on matters of DNA after my husband claimed that some of our children are not belonging to him. When I went  to court I found other things when they are telling me to leave the house and the husband sells it.

Nakiberu alleges that the court proceedings were unjust, accusing the senior principal magistrate grade one court Daniel Bwambale of coercing her into signing papers without proper understanding and denying her the chance to defend her rights.

She claims that the magistrate even threatened to separate her from her children if she resisted.

“Despite my efforts, the court ruled in favor of Matumbwe, compelling me to sign documents sealing the fate of our home and the senior principal magistrate grade one court Daniel Bwambale gave me a period of three months to leave our home so that the husband sells it."

Nakiberu says the land was given to the couple  by her late mother-in-law

“So, we worked tirelessly with my husband and we build the home that he has sold.”

When contact, Matumbwe denied the allegations levelled against him insisting that court followed the due process.

Despite the rift that has torn their family apart, Matumbwe stands firm in his stance, leaving Nakiberu and her children grappling with the aftermath of his actions.

The senior principal magistrate grade one , Daniel Bwambale also denied the accusations, saying he translated the documents to her before signing and she accepted everything.

He also added that what ever he did was in law because Nakiberu and her husband Matumbe were not legally married despite having children together.

Nakiberu and her children now appealing for redress from higher authorities to rectify the injustice they have  faced.

The village chairman, John Kintu and residents said they were shocked by the development, asking for justice for the family.
